1.戦後刑法学の展開の考察に際して、まず最近の論争テ-マである責任論と共犯論を中心に論争発生の経偉、意義、論争においてなにが解決され、なにが未解決のままに残されたかを、判例の状況を踏まえつつ解明するための作業を行った。その結果、責任論に関しては、論争は戦前の学派の争いと関連すること、刑法を社会統制手段として認識したことの帰結であること、規範的責任論の内容の具体的な把握が問題であり、今後の課題でもあること、したがって、見解の対立の解消は可能であることなどが明らかになった。また、共犯論では、処罰根拠に関する争いは図式的に捉えられており、鋭い対立があるかのように理解されがちであるが、処罰根拠論自体に関しては争いはないこと、むしろ、学説は共犯理論を一貫させた場合における結論を補整するためにいろいろなキ-ワ-ドを用いているのであり、したがって、処罰根拠論は解釈原理としてよりも、分析、整理の道具として意味をもつことが明らかになった。2.さらに、学説の歴史的、社会的背景を探るためには戦後社会における刑法の機能を解明することが必要であるので、1の作業と平行して、主として戦後社会において刑事立法の果たした役割を分析するための作業をも行った。その結果、刑事立法の多面的機能と同時に、危険社会においては刑事立法は処罰範囲を拡張する傾向にあるので今後留意する必要があることが明らかになった。3.1の作業に基づく成果の一部については、機会をえたので公表した。その他の論点については、さらに検討を加えるとともに、学説の展開の背景についても検討を深め、刑法学の将来についても具体像を示すべく、考察を行うことにしたい。
