平成四年度申請書に掲げた研究項目を多少変更して研究討論したことを最初に断わっておく。第一のテーマは、共同ボイコットと不当な取引制限(報告者 今村成和元北大学長、コメント和田)。本課題は、原則としてカルテル(三条後段不当な取引制限)に対して課徴金を科することする法改正しながら、共同ボイコット(一般指定十五号一項)にも課徴金を拡大したことの法理論的根拠を探るべく、不当な取引制限との関連を検討した。第二のテーマは、競争価格への行政介入(報告者 稗貫、コメント来生)。この課題は、特定業種の競争市場において、行政指導による価格コントロールが行われたり、違法な価格カルテルに対して公取委が「価格引下げ命令」を出せるか等自由競争市場において公取委がどこまで介入しうるか難しい課題である。第三のテーマは、独禁法二十三条(知的財産権をめぐる独禁法の適用除外)の解釈論(報告者来生、コメント稗貫)。二十三条の性格と適用除外の範囲をめぐる学説は多岐にわかれ、論争の尽きないテーマである。第四のテーマは、特許権や著作権特に著作権と独禁法との関係(報告者 中山伸一横浜国大助教授、コメント来生)。特許や著作権による独占の保護が、国際取引の拡大と共に益々重要性を増している中、特にソフト等の著作権侵害に対処すると共に、どの程度著作権を独占権として保護すべきかにつき、アメリカおよびEC著作権法等との比較法検討を通して討義した。〔村上政博教授(横浜国大)も討論に参加〕。第五のテーマは、不当廉売をめぐる独禁法上の問題(報告者 和田、コメント向田)。この問題の第二のテーマと同様、競争価格に対して公取委が不当廉売として(一応「原価割れ」という法の基準はあるが)どこまで介入すべきか具体的適用基準の設定の因難な問題として討議した。
