わが国と異なり、すでに判例もある(西)ドイツの文献の分析を行い、以下のような状況であることが明らかとなった。「早まった結果惹起」(verfriihte Erfolgseintritt)の表題のもとに論じられている事例には、行為者が予定していた行為の一部しか為さず、そこから既遂結果が発生した場合と、行為者によって結果惹起のために必要だと認識されていた全ての行為が実行された後、その一部の行為によってすでに結果が惹起されていたことが判明した場合、の二種類がある。ドイツの判例の事案は、後者に属するものであり、そこでは因果関係の非本質的な鎖誤にしかすぎないという理由で、行為者に既逐責任が肯定されている。学説には、この判例のようなケ-スの場合には既遂責任を認めてもよいが、前者の場合には未遂責任のみが肯定されるとする「二分説」ともいえる見解と、いずれの場合にも未遂責任のみが認められるにすぎないとする見解、さらにはいずれの場合にも既遂責任を肯定する見解、の三種類がある。もっとも、これらの判例・学説があげる理由付けには、一致したものがあるわけではなく、理論的にも不当なものが多いように思われる。今後、このような判例・学説をさに詳細に検討し、実行の着手(刑法43条本文)として、未遂犯を成立させうる行為から結果がひき起こされた場合に、直ちに既遂責任を問いうるかという問題をなお考察していく必要がある。
