本研究は、農業経営組織、特に一戸一法人の実態調査を踏まえて、組織経営上の、またそれに伴う不動産(主に土地)管理上の問題を検討することを目的とするものであった。まず、実態調査については、大変充実した成果があがった。本研究前に蓄積された調査データに加え、島根県、新潟県の経営組織体(有限会社)、および埼玉県越谷市(組合)、草加市、千葉県市川市、松戸市の調査データを得ることができた。これらデータは、本研究で揃えられたパーソナルコンピュータおよびソフトにより、整理・分類ができ、1.法人化までの経緯、2.経営内容、3.法人化後の問題点を柱に様々な角度からの分析も行えた。特に埼玉県と千葉県に事例については日本土地法学会(関東支部)において、「水田の多面的機能とその活用のための組織」と題する報告をしている。本研究は、水田の作物生産機能以外の機能を維持するための組織(本事例では、民法上の組合)についての問題点を扱ったものである。今後は、これら分類・整理した資料を基に農業経営法人の具体的な問題点、たとえば、1.解散自由発生後の事業継続問題、2.税法上の問題、3.法人の持ち分の個人への譲渡、4.構成員の死亡による相続等について検討していくつもりである。

This study aims to investigate the status of agricultural management organizations, special enterprises and legal persons, and to explore the problems in real estate management. The results of the investigation are as follows: This study was conducted in the cities of Shiba, Shimane, Niigata, Saitama, Koshiya, Kusaka, Chiba, and Matsudo. This study is divided into three parts: 1. Legal personality; 2. Management content; 3. Legal personality; 4. Analysis of the problem points. In particular, the case of Saitama Chiba was reported to the Japan Institute of Land Law (Kanto Branch) on the topic "Multi-faceted functions and utilization of rice fields." In this study, the function of rice field other than crop production is maintained. In the future, the classification and collation of data will be based on the specific problems of agricultural management corporations, such as 1. business problems after dissolution of freedom, 2. tax law problems, 3. personal transition of legal persons, 4. death of members, etc.
