本研究は、いわゆる違法性の意識・錯誤の問題に関して、従来の学説が違法性の意識固有の領域で処理しようとしてきたのに対して、意味の認識論の深化による、故意概念の再構成を行うことにより、新たな解釈原理を提唱しようとするものであった。この理論を構築するためには、この違法性の意識に関して現在有力な見解とされているいわゆる責任説の理論史的背景を明らかにする必要があると考え、ドイツ近代刑法典成立前段階から故意・違法性の意識の問題がいかに扱われてきたかを明らかにした(論文「ドイツ近代刑法典成立前史における故意・違法性の意識」において公表)。また、ドイツのその後の学説史的発展を、登場以前と以降における故意説の変質に注意することによって責任説の学説史的意義を解明した。そして責任説が戦後のBGHで採用され新総則で実定法的に確認された(西)ドイツにおいて、責任説の判例が結論的には、違法性の錯誤の事例について殆ど免責的効果を与えてこなかった点が明らかになった。この責任説の運用上の問題点は今日のドイツでも認識されるにいたっており、意味の認識論の適用によってその矛盾を解消しようとする動きがあり、それらの見解について検討を加えた。一方、ドイツ以外のスイス・オーストリア・フランス・アメリカ各国の外国文献に基づき、比較法的に、違法性の意識・錯誤の処理について調査を行なった。その上で日本の学説ならびに判例を検討し、必ずしも学説の多数が責任説を採用しているとはいえず、最近の判例も責任説から一定の距離をおこうとしていることを明らかにした。そのうえで自説について再検討を加え、違法性の意識とされてきた問題領域を一つは構成要件関係的な利益侵害性の認識として故意の範疇に、また、いま一つは可罰的評価の認識可能性として責任要件の範疇に解消することを提唱下(以上は、著者「故意概念の再構成」において公表)。

The problems in the application of this theory of responsibility are discussed in the following ways: The basic principles of comparative law, consciousness of illegality and error handling in foreign literature of different countries are investigated. The doctrine of Japan is discussed, and the doctrine of majority responsibility is adopted, and the doctrine of responsibility is adopted, and the doctrine of most recent cases is discussed, and the doctrine of certain distance is discussed.
