项目摘要

日本と米国の独占禁止法、及び産業規制法の内容並びに、その運用形態の相違は、両国の経済システムの相違を反映しているのではないかとの問題意識のもとに、日米における独占禁止法及び産業規制法の内容・実態・運用形態を精査し、法律学及び経済学の立場から、その効果・意味を総合的に比較検討する作業を昨年度に引き続き、続けてきた。これを通じて、日米の産業規制をめぐる政策の相違を考察した。以上の共同研究を基礎として、各研究分担者は、以下の各論的研究課題に取り組んだ。植田は、米国シャーマン法の下での独占行為規制の展開を解明した。倉本は、貿易自由化と経済成長との関係について考察した。また、田中は、日米における共同研究開発及び標準化の経済効果について理論的分析を行った。
