本研究は、ハンガリー・スロヴァキア間の国際河川水利用紛争を例として、国際環境紛争処理に関する研究を行うものであった。研究の前提として、環境条約の遵守管理の問題をまず扱った。遵守管理のための法的技術としては、報告、事実調査・査察、モニタリング、紛争処理などの手法があり、これらが有機的に機能して初めて、環境条約の十分な実施が可能となるということが判明した。この成果は、石橋可奈美「多数国間環境条約の実施における『監督』又は『遵守管理』メカニズムの実効性-ワシントン条約(CITES)を例として-」『香川法学』15巻2号(1995年10月)において、公表されている。この成果を前提に、現在、本研究の本論部分となるべき、環境紛争処理について執筆中である。分析の焦点となったハンガリー・スロヴァキア事件については、まだ引き続いて国際司法裁判所に係属中であり、最終的な分析はやはり判決を待ってなされなければならない。しかし、途中経過として、特別のルートで入手されたMemorialを考察した結果、環境紛争処理の重要な構図が明らかとなりつつある。本事件は、通常、環境条約によって提供されるより非公式の紛争処理(問題解決のための政治的議論)を敢えて退け、堂々と定型的な紛争処理の利用を要請したものである。前提となった上記の研究及び論文によれば、環境条約の遵守を確保するための手法としての紛争処理と、このような定型的紛争処理の利用が必ずしも同じ類型でカテゴリー化することが可能かどうかという観点からもさらなる考察が加えられている。今後は、本研究の分析をさらに一般化し、いわゆる一般国際法の遵守概念と国際環境法の遵守概念との間に差異があるのか、あるとすれば、それが国際法学全体にどのような影響を与えているのかなどについても研究を続ける予定である。
