1°留置権の不可分性について-留置権につき不可分性を観念することは不要である。留置権は、その性質上,成立要件が存続要件ともなっている。たとえば、留置物の一部を債権者が債務者に返還したとき、残りの部分について留置権は存続するか、という問題が立てられることがある。しかし、これは、残部について、留置権の成立要件が充足されるか、という問題にすぎない。仮に不可分性が否定されたとしても、残部について別個に成立要件が充足されれば、留置権の成立は認めざるをえないのであり、不可分性の有無で問題が解決するわけではない。2°先取特権の随伴性について-先取特権が特定の債券を保護しようとするものか、特定の債権者を保護しようとするものか、その精密な確定が必要である。従来、安易に前者と考えられてきたが、債権者の生活を保障しようという給料債権の先取特権などは、明らかに後者である。3°不可分性の歴史-不可分性は、フランス古法時代とその相続制度と関連して発達してきたものであり、分割債務の原則をとるか否かに大きく関係している。
