近時、欧州連合のみならず他の国家によって、経済的のみならず、政治的、社会的に大きな影響を与える経済制裁が多用されている。その事例を検討する過程において、共同体および加盟国が徐々に経済制裁を行う共同体権限を認めていったことが明らかになった。このような状況は、マ-ストリヒト条約(欧州連合条約)による共同体諸条約の改正により追認され、現在のEC条約においては、共同体加盟国の制裁権限とともに、経済制裁を行う共同体権限が明示的に認められている。EC条約の制裁に関する規定は、欧州連合における共通外交政策及び共通安全保障条約の一環として行使されることが予定されているが、これらの共通政策は一九九六年に加盟国政府間会議が招集され、その時点までの政策の進捗状況報告に基づき政策の再検討が行われ、とりわけ防衛問題に関しては、西欧同盟設立の基本条約であるブリュッセル条約の一九九八年の期限を考慮し、J4条は改訂されることが予定されている。共通外交政策及び共通安全保障政策について、欧州連合条約が一定の規定をおくが、欧州連合条約の規定は、枠組みを定めるのみである。現実の政策決定にあたっては実行の積み重ねにより、当該政策の範囲及び共同体権限と加盟国権限間の関係が明らかにされなければならず、共同体法の発展的性格を考慮に入れるならば、今後の共同体実行の検討が将来にわたって重要である。
