In this study, International Instrements on human rights are used as a standard of comparative study on natonal law of pre-trial detention. French law and Japanese law are conmpared in this study. AS a result, both French law and Japanese law are cleared to have some subjects to be improved. One of these subjects are use of detention system as a mean of investigation. Another one is existance of long and excessive use of pre-trial detention.

本研究以国际人权公约为标准，对国家审前羁押法进行比较研究。本文对法国法律和日本法律进行了比较。因此，法国法律和日本法律显然都有一些有待改进的地方。其中一个问题是使用拘留制度作为一种侦查手段。另一个问题是长期和过度使用审前拘留。
