项目摘要

本年は、三つの研究を行った。(1)第一は、私が従来から行っている憲法各分野の判例の網羅的・体系的・時系列的研究の一環として、「外国人の人権--国政選挙権・被選挙権、公務就任権--」において、最高裁・下級審の判例から、憲法判断処理の種々のテクニックを抽出し、それらを私の消極主義、積極主義の枠組みの中に整理しながら検討した。国政選挙権・被選挙権における支配的テクニックは、一貫して、「権利保障なし」テクニックであるが、地方選挙権に関しては、「権利保障なし・権利付与可能」テクニックに収斂していること、支配的パラダイムは、「主権者=国民=国籍保有者」、「一元的な中央集権的支配」を根幹とし、伝統的な国家観を維持しつつも、その周辺領域に関しては若干、それを緩和する思想であることがわかった。指紋押捺拒否の事件においては、司法の役割は世論を喚起するフォーラムにとどまったが、最三判平成七年二月二八日は、外国人の地方参政権付与の動きを加速させた数少ない判決の一つである。(2)第二は、「我が国における司法消極主義と積極主義--視点の設定--」というテーマで、これまで明確に述べてこなかった私のアプローチの方法、研究の意義について検討した。そして,本研究の第一の課題を、「憲法各分野における裁判所の憲法判断処理のテクニックを網羅的・体系的・時系列的に整理・分析すること」とし、第二の課題を、「第一の課題にかかわる作業を前提に各分野の整理・分析を総合し、五〇数年にわたる憲法訴訟の全体像をできるだけ精密に明らかにすること」とした。さらに、第一の課題の意義について、憲法判例の網羅的、体系的、時系列的検討により、より広い視野にたちつつ、憲法各分野の解釈論の展開や判例の評価をすることができるとした。(3)第二の課題の意義については、「最近の憲法裁判所導入論議について」というテーマにおいて,大陸型憲法裁判所導入を主張する立場と、他方、これに反対する立場の主張を、幾つかの観点から比較、検討し、より妥当な判断をするためには、憲法訴訟五〇数年の歴史を、下級審判決を含めて、網羅的・体系的・時系列的に分析し、総合的に捉え、評価することが不可欠だと論じた。
