项目摘要

平成13年度の研究では、国際学会発表、セミナー参加、アンケート調査と分析、報告書の作成を行った。学会発表は、第5回International Association of Forensic Linguistsにおける「商標裁判判決のスキーマモデル分析」とJoint Meetings of the Law and Society Association ＆ Research Committee on Sociology of Lawにおける「商標裁判における「混同」という語の言語学的分析」の2本である。平成11年度から本研究の助成を受けて積極的に国際学会発表を行うようになったため、国際法言語学会(International Association of Forensic Linguists)では、理事に選出された。セミナーは、バーミンガム大学主催の法言語学の夏期セミナーに参加した。これにより英米法の法言語学の実態を整理した。アンケート調査は、全国の地方裁判所、県警本部、弁護士会に訴訟手続における事実認定の実態についての調査を行った。法言語学という領域が国内に存在していないため、情報収集を英語圏に求めることが多かった。このためアンケートの項目に日本の実態にそぐわないものがあったが、アンケート調査を通して日本の訴訟手続についていろいろ学んだ。3年間の研究成果は、報告書という形でまとめた。報告書は、アンケートにご協力頂いた最高裁、県警本部、弁護士会と全国の地裁、「言語」に関心のある法学者、「法」に関心のある言語学者に送付した。萌芽的研究であるためやむを得ないのかもしれないが、鑑定人のプライバシーの問題もあり、当初予定していたような総括的な実態報告とはならなかった。しかし、3年間の研究を通して訴訟手続の中で知的財産権の商標裁判に関心を持つようになった。今後は、本研究を基にして、より具体的な商標裁判の言語学的分析へと繋げていきたい。
