项目摘要

本研究では、キリスト教再洗礼派に属するアーミッシュの馬車遅速車標識(SMV)裁判をアメリカの司法界の信教の自由条項の解釈の変遷から考察した。とりあげた馬車裁判は、ミシガン州、ミネソタ州、ウィスコンシン州の一連の裁判である。ミネソタ州とウィスコンシン州の裁判に関しては、担当弁護士、専門家証人、当事者のアーミッシュとのインタビューから入手した資料をもとにして事件の背景も明かにした。シャバト裁判やヨーダー裁判以来の信教の自由に好意的な流れに歯止めをかけたスミス裁判が、ミネソタ州とウィスコンシン州の遅速車標識裁判では不利に適用されなかった経緯について、両州の憲法の信教の自由条項、宗教的自由回復法から詳細に分析した。連邦憲法修正1条の自由条項では信教の自由の抑圧と国教の樹立を禁止しているが、現実のアメリカ社会は、ピューリタン社会の異端や異教に対する排他性も持ち合わせている。主流プロテスタントに近いとみなされるアーミッシュ(ヨーダー裁判)や安息日再臨派(シャバト裁判)の裁判が信教の自由に好意的な判断基準の定石化となる傾向があるが、モルモン教(レイノルズ裁判)やアメリカ先住民(スミス裁判)の信教の自由を巡る裁判は逆に信教の自由後退の判断基準を提供している。アメリカ社会の中にはプロテスタント的キリスト教の宗教観が「見えざる国教」として明かに定着している。本研究では、アーミッシュの馬車裁判から奇異にみえる生活形態であっても、それがプロテスタント的宗教観に基づいているとみなされる場合は、信教の自由として保障されやすいことを論じた。研究の成果は、1998年6月4日にアメリカで開催された「Law and Society」学会の年次大会で「Midwest Amish Court Cases Over the Requirement of Slow-Moving Vehicle Signs」の題目で口頭発表した。拙著『裁判からみたアメリカ社会』(明石書店、1998年)の第3章で「アーミッシュと信教の自由」という題目で、本研究を発表した。尚、本研究の成果は、研究成果報告書としても別途作成してある。
