1 今年度はイギリスにおける担保権と用益権の関係について、社会経済的背景や政策的背景も含めて研究するとともに、これまでのドイツ抵当制度ならびに強制管理制度の研究も踏まえた上で、日本の抵当制度・執行制度を改善するための私見をまとめた。2 イギリスの担保権と用益権の関係については、(1)まずイギリスの賃貸借の内容とその利用状況が規制・保護色の強い「規制賃貸借regulated tenancy」から家賃規制がなく、居住権保証も弱められた「保証賃貸借assured tenancy」へと移行していることを指摘しておかねばならない。(2)今日最も利用されている「保証賃貸借」においては、譲渡抵当権設定後の賃貸借に関して賃借人に占有回復がありうることを書面で通知していた場合には、譲渡抵当権者は住宅を空き家で売るために住宅の占有を回復できるとされている。(3)イギリスにおいては持家政策により持家率が約65%に達しており、賃貸借に関しては家賃規制が排された結果、政府による家賃補助金額が増大している。(4)以上から今日のイギリスでは土地は使用財となっていること、賃借権保護より所有権保護・担保権保護の傾向が強くなっていることを指摘できる。3 ドイツ法も含めた比較法的考察からは、(1)抵当権を侵害する賃貸借・占有屋に対しては、抵当権者がそれを排除できる規定が置かれていること、(2)抵当不動産の賃料から抵当権者が満足を得るためにドイツでは強制管理制度が、イギリスではレシーバー制度が用意されていることを確認し、詳しく検討した。4 したがって、日本においても抵当権に基づく占有妨害の排除を認める規定や法解釈の定着および、抵当権者が賃料から満足を得るとともに、抵当不動産を管理し、占有屋の(再)出現を防ぐために抵当権に基づく強制管理申立制度の創設が必要であると考える。現在行われている法制審議会の担保・執行法制部会において適切な法改正案がつくられることを願いたい。
