アメリカの州政府が1990年代に実施した医療保険制度の改革内容のなかで、まず「契約更新保証」が導入され、合わせて「契約前発病の免責に対する制限」や「医療保険の携行可能性」も導入されている。その後、さらに「新契約加入保証」も実施されている。つまり、「契約更新保証」によって医療保険の既加入者に医療保険の継続を保証し、「契約前発病の免責に対する制限」と「医療保険の携行可能性」によって転職者と離職者に医療保険の継続を保証している。そして、「新契約加入保証」によって無保険者にも医療保険の加入を保証している。こうした改革内容は、保険入手可能性(availability)を改善するとともに、加入者の増大によってリスクプールを拡大し、「保険料率規制」による保険料補助(内部補助)を通じて高リスクの加入者に対する保険料負担可能性(affordability)を改善することをめざしている。そして、1990年代を通じた保険料率規制の一般的傾向として、保険者が保険料率を設定するさいに使用できる要素と保険料率格差に対する制限の点において、厳しい保険料率規制を実施している州が増加している。1990年代の医療保険制度改革は、1980年代の規制緩和・自由化によって生じたリスクプールの細分化・保険料率格差の拡大に対して、保険料率規制を中心とする再規制によってリスクプールを拡大し、保険料率格差を是正することにあった。このことは、保険の市場商品化を抑止し、社会的連帯に転換させるという保険の基本理念の変更を内包している。そして、保険入手可能性と保険料負担可能性を確保し、無保険者の増大を抑止するという政策的要請のためには、給付反対給付均等の原則は民間保険においても普遍的妥当性をかならずしももちうるものではないことを意味しており、今後の日本における保険制度・保険業の規制緩和・自由化のあり方に対して大きな理論的・政策的示唆をもっている。
