项目摘要

During last three years, the research was proceeded by focusing on exploring a new methodological paradigm for law and development studies, as well as on examining the relationships among market, organization and law especially in Asian countries.For the theoretical aspects, I could deepen my typological framework of three laws (indigenous law, imported law and development law) and three legal principles (community market and command), and further newly establish three structures of national legal systems (rule, institution and culture), three social dimension (societal <communal>, economic and political) and three social fields (supra-state <global/regional>, state/national and local). These all concepts, I believe, would make it easy for us understand various legal phenomena under current globalization, including legal transplants, and integration of law among different political, economic and socio-cultural systems in the world.For testing the effectiveness of above methodological frameworks, the empirical research was implemented in the fields of competition law (market) and corporate governance (organization) in Asia, both of which are central topics of law and economic development. The results have been published as a Research Report (Japanese) already. Now, I am compiling a monograph titled "Law and Development : Legal Systems of Asian Post-Developmental States" (Japanese), which includes law and political development (focusing on good governance and human rights), law and social development (dealing with poverty and community justice) and law and international cooperation examining (international) legal technical cooperation and legal transplants. This is expected to be published in the early next year.

在过去的三年里，笔者的研究主要集中在探索法律与发展研究的新方法论范式，以及考察市场、组织与法律之间的关系，尤其是在亚洲国家，在理论方面，笔者深化了三大法律的类型学框架（土著法、外来法和发展法）和三项法律的原则（共同体市场与共同体命令），并进一步建立国家法律的体系（规则、制度、文化）、社会<communal>、经济、政治三个维度和超国家（全球/区域）、国家/国家、地方三个社会领域的新结构。为了检验上述方法论框架的有效性，本文在竞争法（市场）和公司治理领域进行了实证研究在亚洲，这两者都是法律和经济发展的中心议题。研究结果已作为研究报告（日文）发表。现在，我正在编写一本题为“法律与发展：亚洲后发展国家的法律的制度”的专著（日文），其中包括法律与政治发展（侧重于善政和人权）、法律与社会发展（处理贫困和社区正义）以及法律与国际合作，审查（国际）法律的技术合作和法律的移植。预计将于明年初出版。
