Research on System Design suitable for Protection and Use of Creatable Results on the Cyberspace

为了研究适合于网络空间创造性成果保护和利用的制度设计，本研究按计划于2001年至2004年进行。首先，在2001年对真实的世界中的商品流通进行了研究，在日本的法律的制度下，二手电脑电子游戏的销售是否法律的合法，因为在以自由经济体制为基础的日本法律的体制下，商品的自由流通是必不可少的。第二，在2002年和2003年，域名是否不同于商标，不被授予正式域名的情况下，可以检查是否存在在先的冲突商标。因此，问题是商标所有人是否应该对新域名拥有优先权。互联网既不是领土管辖，也不是领土管辖。但知识产权制度受地域原则的支配。在互联网上开展业务与知识产权的地域性原则相冲突。为了找到解决这一问题的钥匙，笔者最终于2004年对世界知识产权组织《关于保护互联网上标志的商标和其他工业产权的建议书》进行了研究。今后的研究应继续进行，并对世界知识产权组织的建议提出建议.

In order to research system design suitable for protection and use of creatable results in the cyberspace, this research was carried out as planned from 2001 to 2004.First, in 2001,the research in circulation of merchandise in real world was done, whether under the Japanese legal system sales of second-hand computer video games are legal or not, because free circulation of merchandise is essential under the Japanese legal system which is based on a free economy system.Second, in 2002 and in 2003,whether domain name, unlike trademarks, are not granted in formal domain names leaves it up to check the existence of prior conflicting trademarks. Therefore, the question is the owner of trademarks should or should not have priority over the new domain name.The internet is neither territorial governed nor territorial governable. But the system of intellectual property right is governed by the territorial principle. Doing the business over the Internet is in conflict with the territorial principle of Intellectual Property. To find a key to the settlement of the problem, finally, in 2004,I researched WIPO Recommendation concerning the Protection of Marks and Other Industrial Property rights in Signs on the Internet. This research in the future should be continue with the suggestion to WIPO Recommendation.
