日本と韓国との住民投票制度についてなによりも大きな相違となっているのは、日本の場合住民投票に関する法律が成立していなく、地方公共団体が制定する条例として住民投票を行っていることに比べて韓国では住民投票法を制定、適用することである。2003年12月に制定された韓国の住民投票法の特長は次のようである。住民投票権を有する投票資格者について、国籍の要件はないため、外国人でも20才以上の住民であれば、地方自治団体の条例の定めるところにより、住民投票権を有する(第5条)。住民投票の対象は、住民に過度な負担を与え、または重大な影響を及ぼす地方自治団体の主要決定事項で当該地方自治団体の条例に定める事項と規定し、例外的に住民投票の対象としない事項として予算支出などの財務に係る事項と公務員の身分に関する事項などを挙げている(第7条)。韓国の住民投票法第8条では、中央行政機関の長が、地方自治団体の廃置分合、または区域変更、主要施設の設置等の国家政策の樹立につき、住民の意見を聴くために必要と認める時は、住民投票の実施区域を定め、関係地方自治団体の長に対し住民投票の実施を要求することができると定められている(第8条)。住民投票の拘束力については、住民投票の結果に法的拘束力をもたせるか、諮問的ないし参考的な効果に止めるかという問題にかかわる。韓国の住民投票法では、地方自治団体の長及び地方議会は、住民投票の結果の確定通り、行政・財政上の必要な措置をしなければならないと定める(第24条)が、この規定は文面とおり見ると拘束力がある義務的な規定と考えられる。そのように解釈すれば、住民投票に法的拘束力を認めるという点で、韓国の住民投票制度が日本の制度とはもっとも異なると思われる。韓国と違って日本ではほとんどの住民投票条例に法的拘束力が認められず、その住民投票の結果を尊重するに止まっているからである。

Japan and South Korea's indigenous voting system is in violation of each other. Japan's indigenous voting laws have been established and local public organizations have enacted regulations for the implementation of indigenous voting. In December 2003, Korea's Indigenous Voting Law was enacted. Article 5: Citizens eligible to vote, nationality requirements, foreigners, residents of 20 years or older, regulations of local self-governing bodies, citizens eligible to vote (Article 5) Article 7: Issues relating to the status of civil servants, matters concerning the burden and impact of the indigenous vote, and matters concerning the main decisions of the local self-governing body, matters concerning the regulations of the local self-governing body, and matters concerning the budgetary expenses and financial matters. Article 8 of Korea's Indigenous Voting Act provides for the establishment of national policies such as the head of the central administrative organ, the division of local self-governing bodies, the change of regions, the establishment of major facilities, the recognition of the opinions of the inhabitants, the determination of regions for the implementation of indigenous voting, and the determination of requirements for the implementation of indigenous voting related to the head of local self-governing bodies (Article 8). The binding force of the indigenous vote, the binding force of the law of the indigenous vote, the effect of the consultation, the question, the question, Korea's Indigenous Voting Act provides for the determination of the results of the Indigenous Voting by local self-governing bodies and local councils (Article 24). The binding force of the indigenous voting law is recognized. The indigenous voting system in Korea is different from that in Japan. South Korea's violation of Japan's Indigenous Voting Regulations is binding on the law and respects the results of indigenous voting.
