本研究は、12世紀イングランドにおける重罪聖職者をめぐる国家(俗権)と教会(教権)の関係およびコモン・ローとローマ・カノン法の法理形成を、1154年に起きた大助祭オズバートによるヨーク大司教ウィリアムの毒殺事件を主たる考察対象としてこれに関係する史料群を検討することにより、解明することを目的としたものであるが、昨年度中に達成することができた、(1)ヨーク大司教ウィリアムの毒殺事件に関わる研究史の整理、(2)関連史料の精読、(3)イギリスにおける未刊行史料の収集をふまえて、今年度に達成することができたのは、以下に示す諸点である。まず、第一に、ヨーク大司教毒殺事件について、その背景・経過を整理することにより事件を再構成するとともに、相対化のために別の事件についても整理することができた。第二に、ヨーク大司教毒殺事件等の実務に関与した知識人達(とくに注目すべきはギルバート・フォリオット)による重罪聖職者の取り扱いをめぐる法理論を分析することができた。第三に、最近発表されたマックハーディーの論文を含め、12世紀における重罪聖職者をめぐる国家(俗権)と教会(教権)との争いの結果たる「聖職者の特権」に関わる先行研究をおおむね整理することができた。第四に、国内では入手不可能な未刊公史料を中心に、ケムブリッジ大学図書館、オクスフォード大学ボドリアン図書館において史料を収集することができた。この際、12世紀に作成されたとされている法集成(重罪聖職者の問題にも関わる法令が収録されている)を閲覧・検討することができた。第五に、前述のイギリスの各図書館に保管されている史料について検討をすすめることにより、従来の重罪聖職者に関する研究に用いられてきた史料は「伝記」が中心であったという、従来の研究の史料上の限界を指摘することができた。第六に、以上の成果の一部を、2002年8月開催の西欧中世史研究会で発表し、有益な意見を得ることができた。
