项目摘要

(1)昨年度は、イングランド(連合王国)の各図書館をめぐるとともに、何人かの研究者にインタビューをおこなった。本年度は、第一に、同様のことをアメリカ合衆国マサチューセッツ州ケンブリッジでおこなった(もっとも、イングランドで済ませているはずの支払いが今年度も必要であった。大量にあるため、分割して、それぞれについて前払いを済ませなければマイクロフィルムが送られてこない仕組みになっているためである)。今回は、いろいろな図書館をめぐることはせず、もっぱらハーバード大学ロースクール図書館に通った。第二に、--研究が少しずつ進むにつれて--ふたつのことがわかってきた。(1)ヨーロッパ民法典に向けた動向のなかで、日本ではほとんど知られていないGiuseppe Gandolfiらのグループが重要であること(イングランドのLaw Commissionが起草したContract Codeを発掘したのは、かれらであった)、(2)近年のイタリア比較法学(とくにRodolfo Sacco)がこの研究の方法に不可欠であること(ヨーロッパ大陸法のアメリカ化に対する批判的パースペクティヴを提供する点できわめて重要である)、これである。そこで、イタリア現地に飛んで現地語の資料を収集するとともに現地の研究者にインタビューを試みることが必要であることを再認識した。(2)第一のハーバード大学ロースクール図書館通いは、--未公開資料収集に役だったほか--、予想を超えた帰結をもたらした。たしかに、当地の研究者らがイタリア比較法学を高く評価してそのパラダイムを採用していたことは知っていた。しかし、実際にかれらのミーティングに参加することでこれを実地で体験することができた。そこで形作られたコネクションがなければ、イタリアへの旅行は事実上困難であったろう。第二のイタリア旅行は、ふたつの点で有意義であった。(1)日本で入手できるイタリア文献はきわめて限られている。これを効率的に収集することができた。(2)わたしの語学的能力もイタリア「語」文献を読みこなすにはきわめて貧弱である。英語でインタビューすることで、この欠点を補うことができた。(3)イタリア旅行の直前に、今回の課題のいわば各論部分を形成する、以下のような論文が、ある雑誌に採用され、これを書き直して脱稿することができた。その論文は、ある契約法上の論点をめぐって、二人の比較法学者の受容と反発を描こうとしたものであった。(1)これは、期せずして「大」論文になった。すなわち、期間としては1930年代からこんにちにいたる、地理的にはイングランド(その支配下にあったインドを含む)、アメリカ、ドイツ、イタリア、そして古代ローマにわたるものとなった。(2)そこではユダヤ系ドイツ人とウェールズ系アメリカ人がとりあげられている。ナチ支配は、大量のドイツ人のアメリカ亡命をもたらした。本論文は以下の含意をもつ。亡命がアメリカ法のヨーロッパ化をうながした深刻な帰結のひとつが、今日のグローバリゼーションである、というものである。
