The Influence of Books of Authority on the Modern Law Practice and Jurisprudence

本文主要研究了两个方面的问题，并取得了一定的成果：一、对《黑石传》部分版本页码不一致的研究与解决。“第一版的页码在第1卷和第4卷中很早就发生了很大的变化。学者们认为，星星标页版本解决了标页之间的差异问题。但是，实际上有两种类型的分页与星星标记（^*）。有人说，第12版是原来的分页的星星分页版本。但我们发现这是不正确的，甚至在一些星星页码版本之间的页码也有很多差异。为此，我们对《评点》的几个典型版本的页码编制了对照表。“我们认为这是第一个成果，在英美法学术领域是非常有用的。2.权威著作对现代法律实践和法理学的影响。我们研究了黑石的《评注》中有多少词语被两部著名的法律词典引用或参考，即，布莱克的法律词典第1版（1891年）和Ballentine的法律词典（1948年）。我们发现，每本词典都有大约1500个例子，其中大多数是英美法和法理学中最基本的法律的术语和概念。我们可以说，权威著作（黑石的《评注》）对现代法律实践和法学有着巨大的影响，即使在今天，也可能在将来。

We had two main researches and have got results.1.The research and solution of the discrepancies in paginations among some editions of Blackstone's "Commentaries."The pagination of the 1st edition had changed early and largely, in the volume 1 and 4. Scholars have believed that the star pagination editions have resolved the problem of the differences among paginating. But, in fact there are two types of the pagination with star mark (^*). It has been said that the 12th edition is the original paginations of the star pagination editions. But we have found it is not true, and there are a lot of the discrepancies even in the paginations among some star pagination editions. So we have made some contrastive tables of the paginations of some typical editions of "Commentaries." We believe this is the first result and is very useful in the academic field of Anglo-American law.2.The Influence of Books of Authority on the Modern Law Practice and Jurisprudence.We have researched that how many words and phrases in Blackstone's "Commentaries" are cited or referred in two of the famous Law Dictionaries, that is, Black's Law Dictionary 1st edition (1891) and Ballentine's Law Dictionary (1948). We have found there are about 1500 examples in each dictionary, and most of them are in the most fundamental legal terms and conceptions in Anglo-American law and jurisprudence. We may say that the books of authority (Blackstone's "Commentaries") have the enormously large influence on modern law practice and jurisprudence, even today and probably in future.
