项目摘要

本年度は、5月から6月にかけてポワティエ大学よりゴドラ教授とグレゴワール研究員が来日したことに伴い、上記研究課題にかかる研究は中断に近い状況となった。その代わり、フランス著作権法にかかる基礎的・一般的な研究と、時事的な研究を進めた。後者にあたるのが、下記「研究発表」欄に記載したフランスの書籍公貸権制度に関する2篇の論文である。1篇目は、来日したグレゴワール研究員が日仏図書館情報学会でおこなった報告の全訳である。2篇目は、その後このテーマに関して自ら調査し、関連の法令を翻訳(南亮一氏と共訳)した成果を、まとめ直したものである。ここでは、2003年に制定された書籍公貸権法と、2004年に制定されたその施行規則、さらにフランスにおける先行研究を調査し、書籍が図書館において営利目的でなく貸し出される場合に、著作者への報酬を徴収・分配する仕組みを明らかにした。前者にあたるのが、フィリップ・ゴドラ「著作者人格権の一般理論-フランス法を例に」の翻訳である。これは5月29日に著作権法学会で口頭報告した。その後、ゴドラ教授による加筆修正があったため、学会誌掲載は1年遅れて、2005年度分にあたる32号となる予定である。原論文(未公表)は重厚にして長大で、その前半は、フランスにおける著作者の権利概念の歴史的形成についてであり、古代に始まり10世紀ものタイムスパンをもつ。そこでは、著作権法の生成が、フランス史(特に経済史)や所有権思想の歴史の中に見事に位置付けられている。後半は、そのような歴史的背景を前提としつつ、現行フランス著作権法における著作者人格権の制度と運用を、具体的に明らかにしている。翻訳が公表されれば、日本におけるフランス著作権法の理解はより豊かになることであろう。科学研究費補助金の使途としては、50万円を超える設備備品はない。物品費としては、前年度から引き続き購読しているフランスの専門雑誌の購読料、いくつかの書籍、そしてモバイル用のパソコンが挙げられる。旅費としては、年度の終わりにポワティエを訪問し、ゴドラ教授と上記論文の翻訳をめぐる打ち合わせをした際の外国旅費が挙げられる。また、フランス著作権法に関する資料のデータベース入力に、謝金を支出した。
