本年度は、当初の研究計画の通り、1)刑事裁判の準備手続に関する日本のこれまでの議論の流れを分析するとともに、2)アメリカの刑事手続きにおける公判前会議(Pretrial Conference)についての研究に従事した。合わせて、昨年度に調査研究を実施した、3)イングランド・ウェールズの刑事手続きにおける答弁指示聴聞(Plea and Directions Hearings)の研究をさらに進める作業を行った。具体的には、まず1)については、主に現在進行中の司法改革で議論されている準備手続創設の動向の把握と1960〜70年代に議論された集中審理論について、主に研究した。さらに、日本の刑事裁判において当事者主義が導入される過程での、1950年代初期頃の邦文文献についても、調査を開始した。2)については、アメリカ連邦刑事手続について、刑事手続規則、判例の分析を行うとともに、当事者主義訴訟における公判前会議の機能について判事、研究者による論文を収集、分析した。さらに、今年度3月にアメリカ・ワシントンDCに赴き、連邦裁判所判事をヒアリングするとともに、Federal Judicial Centerで資料、情報等を収集した。また、ジョージタウン大学刑事法臨床プログラムのエーブ・スミス(Abbe Smith)教授からヒアリングを行い、手続上の性格、弁護士実務の実際を調査した。3)については、イングランド・ウェールズの公設弁護人オフィスの創設についての研究ノートをまとめた。また、実際のヒアリングをもとに、答弁指示手続のこれまでの歴史、具体的手続をまとめ、2年ほど前に出されたオールド報告書において、答弁指示手続がどのように扱われているのか、それについての各方面からの評価等を分析した。なお、3)の成果については、10月に日本刑法学会名古屋部会にて「刑事裁判の準備手続について-イギリスにおけるPlea and directions Hearingsを素材として-」のタイトルで報告した。

In the early 1950s, Japanese criminal adjudication began to introduce party doctrine into the country. 2) Collect and analyze the papers of the court and researchers on the functions of the pre-judgment conference, including the analysis of criminal procedures, criminal procedures rules, and precedents, and litigant-based litigation. In March of this year, the Federal Judicial Center collected data and information. Professor Abbe Smith investigated the conduct, personality and practice of nurses in the criminal law clinic of the University. 3) The author of this article is interested in the research and development of this article. Analysis of the history, specific methods, and reports issued two years ago of the survey, the analysis of the indicators, and the evaluation of various aspects of the survey. 3) The results of the report were presented at the Nagoya Department of the Japanese Criminal Law Society in October.
