第一に、大規模小売商業施設の設置に関して改正された建設法典2条2項や34条を検討した。国土整備の目標は伝統的には自治体の権利を設定しないとされてきたが、隣接ゲマインデに対して衡量原則に比して法的により強固な法的地位を設定する考え方が一部の判例に取り入れられ、計画による克服の原則と同様に、計画裁量の統制の多様化を導いている。具体の建築許可手続(34条による場合)において自治体の行政能力の限界に鑑みる見解があり、2条2項改正と相俟って土地利用の抑制的方向での規制が強化されている。第二に、土地利用秩序の個別的な実現手段である建築許可手続における裁量の民間化・手続簡素化の中での変容を公私協働論に焦点を当てて検討した。行政手続法改正論議では公私協働に相応しい手法に対する法的規律が今日的な課題となっているからである。即ち、一方で、法治主義的観点からの結合禁止法理による私人への不当な負担の抑制、他方で「違法=無効」という枠組みやその背後にある公行政遂行に際しての私益への不信感が従来見られたが、公私協働を進めるべく行政主体・私人に手続上の責務・義務を課す方向の提案が見られる。また、公私協働が癒着に陥ることを防ぐために行政契約の場合でも第三者の法的地位が、行政主体の負い続ける保証的責任を具体化すべく情報権や契約不履行時の介入権が従来以上に強調されている。公私協働契約に対する法的規律は、利害の輻輳する状況では行政行為手法が用いられる場合にも妥当すると考えられる。第三に、日本法との比較研究として、既成市街地の市街地像を参加手続の中で具体化する点は簡単に触れるに留まった。手続簡素化の流れに関連して、指定検査確認機関の交付した建築確認を周辺住民が争う場合の当該機関の法的地位について検討した。手数料を収入とする私的利益を追求する独立の法主体を審査請求に際して下級行政機関同様の地位に置くことの問題を指摘した。
