平成15年度は、近年における処罰領域の変化を明らかにすべく、(1)現代型の犯罪形態や諸問題を概観するとともに、(2)その理論的問題について検討した。(1)として、まず、最近の児童虐待事例におけるネグレクト(保護の不作為)問題や、刑事製造物責任をめぐるリコール隠しの問題、経済犯罪と詐欺の問題などについて、判例・文献の収集・整理を行った。また、刑事弁護研究会等にも参加し、諸事例(判例)の実務上の問題点についても検討を加えた。つぎに、以上の作業と並行して、最近の立法動向を調査した。その際、比較法的観点からの検討を可能とするために、ドイツにおいても判例・文献の収集作業を行った。また最近の刑事立法の傾向を知る上でも重要なテーマである「刑罰目的」に関する学術講演会に参加し、ドイツの状況と最新の考えに目を向けた。つぎに、(2)として、(1)で概観した諸問題ととくに関わりの深い不作為による共犯の問題について検討した。まず、(1)で示された具体的な事例が理論的にはどのような形で問題となるのか、諸事例と不作為犯・共犯の理論的問題との関わりを明らかにした。つぎに、諸事例の実際的な解決に際しては、「支配」や「惹起」など、事実的要素をキー概念とする従来のわが国の理論には限界があることを指摘した。以上の成果は、2003年度『立命館法学』5号(2004年3月末発行予定)誌上および『甲南法学』44巻3・4号(2004年4月発行予定)誌上に掲載される予定である。また、成果の一部は、『はじめての刑法』(伊東研祐編著・2004年4月発行予定)誌上でも明らかにした。

In 2015, the changes in the field of punishment in recent years were clearly discussed;(1) the problems of modern crime patterns were summarized; and (2) the theoretical problems were discussed. (1)In addition, the author also conducted research on the recent cases of child abuse, criminal product liability, crime and fraud, case law and literature collection and collation. The Criminal Defense Research Association participated in the discussion of practical problems of various cases (precedents). In addition, the above tasks are carried out in parallel, and recent legislative trends are investigated. The research of the comparative method is possible, and the collection of precedents and documents is carried out. Recent trends in criminal legislation are important to understand, participate in, and review in academic seminars on criminal purposes. The solution of the actual case is to "control" and "cause", and the elements of the case are to be criticized. The above results are published in the 2003 "Ritsumeikan Law" No. 5 (issued at the end of March 2004) and "Kanan Law" No. 44, No. 3.4 (issued in April 2004). The first part of the book,"Criminal Law"(edited by Kensuke Ito, published in April 2004), is published in the journal "Ming Shu".
