项目摘要

今年度は研究期間の最終年度であり、研究全体の総括を行うとともに、今後の課題を展望し、さらに発展的に研究が展開できるよう、企画、構想を行なった。前年度に引き続き筆者自身の後見活動を基に検証、検討を行うとともに、主として社会福祉士会・成年後見センター「ぱあとなあ」活動、および成年後見制度、後見活動に関わる社会福祉士への個別調査を実施した。特にケーススタディについては質的研究方法を用いてデータ収集、分析をおい、今後につながる課題を明確化した。また、成年後見制度の実状を把握し、課題の所在を探るための統計データ等の検討も継続的に実施した。日本成年後見法学会等の学会活動を通して弁護士、司法書士等関連専門職の後見活動に関しても情報を収集し、併せて研究成果については日本社会福祉学会第53回全国大会において発表を行った。成年後見制度の定着度等を臨床的に検討するため、知的障害者施設における成年後見制度に関する説明会、地域での相談会、養護学校保護者会講演等に従事した。1.成年後見制度の利用状況について司法統計によれば成年後見制度利用件数は制度導入1年目より年を追う毎に増加している。徐々に知的障害者、精神障害者の制度利用も進んでおり、社会的支援体制としての成年後見制度の一層の定着が課題である。2.知的障害者に対する後見活動の課題知的障害者の後見活動について、今年度は特に社会構成主義的な視点で検証を行い、身上監護と生活支援、実践課題、後見活動課程の課題、被後見人-後見人関係等について考察を行った。後見活動においては、個別の事情や状況が多岐にわたっており、統計的に全体像を押さえるとともに、その実態はケース毎に検証することが有意義と考えられる。3.今後の課題障害者自立支援法、高齢者虐待防止法など新しい法制度のもとでの権利擁護体制の構築についてさらに研究を深めたい。
