本研究は、法と経済学の視点から、音楽、放送用コンテンツ、映画、書籍等の大衆消費著作物の既存流通及び制度について詳細かつ実証的に分析を行い、それに基づきIT時代の著作物流通のあり方を考察するものである。それらに対するITの影響を分析し、IT時代の豊かなコンテンツ育成の環境形成(産業政策や競争政策)の一助となることを目的としている。本年度は、まず、音楽著作物の流通に関するこれまでの研究(樺島[2001])を基礎に、著作権等管理事業法に基づく報酬請求権的な著作権許諾のあり方が、通信カラオケ・着メロ等の、ITを活用した新規流通事業の成立に寄与したことを明らかにする論文を執筆した。この論文は、林[2004]第7章に収録された。次に、出版物流通に関して、インタビュー調査を行い、返品制度や入金制度に関する慣行を把握した。また、映画の流通に関して、既存文献に基づく事実の把握に努めた。上記のような現状の把握から、著作物の特徴的な販売のあり方を考察し、これを前提としてITによる流通販売はどのように位置づけられるかを明らかにすることを試みる論文を、現在、執筆中である。今後は、さらに映画、書籍、放送用コンテンツの流通の実態の把握に努めるとともに、執筆中の論文のアイディアをベースに、ITによる流通を促進する制度についての考察を進める予定である。樺島榮一郎[2001]「経済学からみた音楽著作権及び著作隣接権使用料徴収方法についての考察」『情報文化学会論文誌』,2001年12月,第8巻第1号,pp.61-69林紘一郎[2004]『著作権の法と経済学』勁草書房
