项目摘要

平成15年度〜平成16年度にかけて、アメリカやドイツにおける証明の負担を軽減するための理論を、要件事実論から始まり証明責任論・証明責任の軽減の法理の順に詳細に検討してきたが、平成17年度は、それらを踏まえた上で、わが国の訴訟当事者の証明困難を解消するための種々の方策を考えてみた(この成果の一部はすでに発表済み)。その結果、当事者公平の見地および真実の発見の見地からは、むしろ端的に民事の証明度を「優越的蓋然性」あるいは「証拠の優越」原則に置き換えるべきであるとの結論を得た。その検討過程では、証明論全般にわたって再構成を検討し、従来「証明度」という概念でひとくくりにされていたものが、実は4つの概念に分けて説明できることが判明した。第一に、事案の「解明度」と、事実の蓋然性を示す「証明度」とが区別されるべきであることが判明した。第二に、「解明度」および「証明度」は、当事者の証明活動の内容であって、裁判官の内面活動は、別の概念で示すべきであるとの結論も得た。すなわち、裁判官の事案の「解明度」が高くなったことの心証としての「心解度」(筆者造語)と、最低の「証明度」を充たしたとの確信をえることの「心証度」である。そして、高い程度が要求されるのは、「証明度」よりもむしろ「解明度」であり、事案の解明が十分なされれば真実性が担保され得、証明度については、対等な当事者間の活動として、相手よりも優越的蓋然性を示せれば足りると考えた(残りの成果を平成18年度に公表する予定)。
