项目摘要

今年度は、5つの研究課題のうち(3)ナチ司法の解体と司法の民主化改革、(4)東ドイツにおけるナチ犯罪追及の実態と東西ドイツ司法の相互関係、(5)連合国裁判の受容とジェノサイドを予防する司法システムの形成、に取り組んだ後、(1)西ドイツ及び統一ドイツにおけるナチ犯罪の司法訴追の展開、(2)ナチ犯罪裁判と公共の記憶の形成、も合わせて総合的な考察を行い、研究を総括した。第二次大戦後のドイツが行なったナチ犯罪追及の展開を明らかにし、戦後政治の発展のなかに位置づけるとともに、その成果と闇題点、並びにそれらの法的、政治的、社会的な要因を分析した。その際、異なる政治・司法制度のもとで行なわれた東西ドイツのナチ犯罪訴追の特質や連関、両国の相互批判が及ぼした作用も検証した。また、連合国による戦犯裁判や戦後に制定された法規範への対応、冷戦後のドイツが展開しているICC(国際刑事裁判所)支援政策についても追究した。ナチ犯罪追及は、ナチ不法の実態解明、ナチ時代に関する歴史認識や歴史研究の深化、ナチズム後の法意識の再建や司法制度の改革など、個人の刑事責任の確定をこえる多面的な効果をもたらした。こうしたドイツの事例を、ジェノサイド等の重大な国際犯罪の処罰・予防と事後の社会再建という国際的、普遍的な視点からも検討し、犯行者の処罰と法の支配の回復、住民間の和解、加害・被害の事実究明と公的記憶の形成、法・司法制度の民主化、などから成る複合的プロセスとして、司法分野の取り組みが果たしうる役割を考察した。研究成果は、『季刊戦争責任研究』(2008.3刊行)、『ドイツ研究』(2008.4刊行予定)に掲載の論文、『図説ドイツの歴史』(分担執筆、2007.10刊行)で発表したほか、日本学術振興会人文・社会科学振興プロジェクト研究事業・領域II-1「ジェノサイド研究の展開」主催の国際シンポジウム(2008.1)でも口頭発表を行った。
