项目摘要

昨年度は、組織における個人の行動原理に焦点をあて、それが日本社会の中でどのように評価されて、通報者自身のもつリスクにつき検討した。これをふまえて、今年度は、個人に対して、様々なリスクを生み出すこととなっている「世間」という視点から検討を行った。通報者のリスク軽減のために仮に通報報奨金制度を導入したとしても、異質な行動をとることを極端に忌み嫌う「世間」の中では、妬みとなって通報者に更なるリスクを生み出すことになりかねない。企業等による自主的行動基準の制定にさいしても、組織によって程度の差ころあれ、とりあえず「世間」さまに対するパフォーマンスとしての機能をはたすという機能も少なからず有している。ただ、だからといって、こうした基準の制定の意義が希薄であるというわけではない。組織や個人の意識を少しずつでも変革させるためには、こうした「世間」の目をいかに活用するかが重要であると同時に、今後とも「世間」なるものの孕む病理を踏まえた制度設計が必要である。公益通報者保護法の制定も、「とりあえず」は無意味ではなかったと思われるが、「公益通報」を促すという意味では問題山積である。公益通報の問題は、私人がいかにして、どの程度、国家や社会の問題に積極的に関わるかという問題であるが、個人に過大な負担を強いることを前提とした制度設計を行うべきではない。こうしたことを踏まえ、木更津市生涯学習市民講座(2006/9/30開催)において、「義民伝承と公益通報者保護」という論題で講演した。
