本研究は平成17年度において、平成16年度までの研究成果を基礎に、以下の点を明らかにした。すなわち、平成16年度までの研究成果において、(1)ドイツにおける個人情報保護が基本法1条1項及び同法2条1項から導き出された一般的人格権のひとつである「情報に関する自己決定権」(das informationelle Selbstbestimmungsrecht)に基礎づけられていること、(2)同権利の概念が定立されたのは個人情報のコントロールを本人の自己決定に委ねることが情報化社会における個人の自由を保障するための前提条件であると考えられていることを明らかにしたが、その成果を基礎に平成17年度においては、平成15年5月(平成17年4月施行)に日本において成立した「個人情報の保護に関する法律」(以下、個人情報保護法という)が日本の労働法のなかでどのような位置づけを与えられるべきかを検討した。そして、個人情報保護法について、(1)その保護法益を労働者の私生活領域の保護ではなく労働者の行為自由と捉えるのが適切であることを主張し、(2)個人情報保護法が規定する「許容生の要件」について解釈の試論を提示した。研究成果は、平成17年5月に行われた日本労働法学会109回大会において「ドイツにおける労働者の個人情報保護---労働法における『個人情報の保護に関する法律(平成15.5.30法57)』の位置づけのために」のテーマのもとで報告され、また、同タイトルで日本労働法学会誌106号(2005年、法律文化社)に公表された。

This research is based on the research results of Heisei 17 and Heisei 16, and the following points are made clear. Research results for the year 2016: Article 1, Item 1, and Article 2, Item 1, of the Basic Law on Personal Information Protection (das informationelle Selbstestimmungsrecht) Basic information: (2) The concept of equality and benefit is established. Personal information is determined by oneself. Prerequisites for individual freedom protection in an information society are discussed. The foundation of this achievement was established in May 2015 (implemented in April 2017) and the "Law on the Protection of Personal Information"(hereinafter referred to as the "Personal Information Protection Law ") was established in May 2015.
