Legal research on the dispute resolution many people expect

很多人真的对民事诉讼的判决感到满意吗？法院是否满足了他们的期望？本研究旨在通过统计的方法界定人们所期待的纠纷解决方式，并从这一新的角度研究日本的立法、判例和理论。从2005年到2007年，我们进行了以下调查，取得了以下结果：(1)问卷和调查的标题我们设置了关于不动产转让、不动产租赁、个人财产转让和不当得利等约15个案例，并对千叶大学、早稻田大学、Rissho大学、美伊加廷大学等约1500名学生进行了问卷调查。(2)关于上述问卷的立法、判例、理论综述。并于2006年9月访问了柏林自由大学和哥廷根大学，与德国的一些教授和实践者就这一主题进行了讨论。(3)本研究的结果和检验分析。我们对上述问卷进行了分析，研究了日本和国外的立法、判例和理论。在这些研究成果上，我们描述了当前存在的问题和未来许多人期待的纠纷解决的理想方向。然而，仍然存在一些问题。我们认为我们希望在不久的将来解决这些问题。

Are many people really satisfied with in a decision in a civil action? Dose the court answer their expectations? This Research aims at defining the dispute resolution many people expect by the statistical approach and studying legislation, precedent and theory in Japan from this new point of view. We made the following surveys from 2005 to 2007 and achieved the following results.(1) Headings of questionnaire and SurveyWe set about 15 cases on the conveyance of real property, the lease of real property, the conveyance of personal property and the unjust enrichment etc, and put the questionnaire into practice to about 1500 students at Chiba University, Waseda University, Rissho University, Meigigakuin University etc.(2) Survey of legislation, precedent, theory on the above questionnaireWe referred to some books about legislation, precedent, and theory in Japan and foreign countries(e.g. Germany, France, England and so on). And we visited to Free University of Berlin and University of Goettingen at September 2006 and discussed about this theme with some professors and practitioners in Germany.(3) Analysis of this research results and examinationWe analyzed the above questionnaire and studied legislation, precedent and theory in Japan and foreign countries. On these research results, we described the current problem and future desirable direction of the dispute resolution many people expect. However, there are still some questions. We think we want to solve them in the near future.
