欧州連合(EU)は国際条約により設立されたが、欧州司法裁判所により実質的憲法化が行われた。それは、加盟国憲法との共存を前提とする「立憲的多元主義」という概念で説明することができる。EUの実質的憲法を成文化する試みであった欧州憲法条約の挫折を踏まえながら、リスボン条約という形で従来の形式が維持されつつも、実質的憲法の強化が行われつつある点の解明を行った。他方、域内市場における自由移動との関係で、法政策面における立憲的多元主義の限界もまた明らかとなった。
