本研究は,カントの提唱したコスモポリタン法という概念に注目して,グローバリゼーションおよびりージョナリゼーションの進む世界における国際法形成過程の実質的・制度的な変容を分析した。そこでは,一方で,国家(政府)によってほぼ独占されていた国際法形成過程への非政府組織(NGO)などの介入がその専門的知識や世論喚起力などを柢子として増加していることが実証的に解明された。他方で,そのような介入は,もともとロビイングや専門的知識を欠く国家(政府)・の代表団への参加などの形式でなされていたものが,EUなどの地域機構や国際仲裁などのように,制度的にNGOや専門家という資格での正式な参加へと制度化される例が増加していることも解明された。このような国際法形成過程への参画のチャネルの増加によって,形式的には国際法だが実質的な内容はコスモポリタン法というべきものや,制度化されたコスモポリタン法-EU二次立法のような国際公務員定立法など-が生じており,それらの正統性が民主性という基準を用いて争われることになる。すなわち,国家の多数者を代表している(とされる)政府代表団に対して,国家内では少数者である人びとの利益を国際法形成過程に正当に代表させるチャネルとして国際法などの民主性を高めるのか,逆に,国内的な民主的正統性をもたない少数者が過剰代表されるという意味で民主性を低めるコスモクラシーヘの堕落-のかが争われるのである。本研究は,国法の一部である国際法の変容を解明し,今後の国際法学,とりわけ普遍的・地域的な国際機構による法形成を対象とする国際組織法学においては,コスモポリタン法の正統性の確保するための制度化が課題となる,という知見を得た。そして,国法のもう1つの構成要素である国内法に対するコスモポリタン法の影響の実証分析は今後の研究の課題として残された。

This study focuses on the concept of international law, and analyzes the qualitative and institutional changes in the process of international law formation. On the one hand, the state (government) has the exclusive right to participate in the formation of international law, and the involvement of non-governmental organizations (NGOs) in the knowledge and world theory of the relevant departments has aroused the power of the state (government) to increase the power of the state (government) to explain the facts. This paper presents a practical analysis of the influence of the national law on the development of the national economy and the problems of future research.
