本年度は、現代国際法における対抗措置の法的性質につき、理論的及び国際実践をふまえた研究を行い、成果をとりまとめた。対抗措置については戦間期より、相互主義的な正当化事由とする見解(相互主義的紛争処理手続論)、国際法秩序からの価値的非難(法的制裁論)とする見解、そして国際法上の強制執行手続(強制執行論)として捉える見解が見られる。これらは国際紛争処理の法構造との関係につき、それぞれ固有の前提的な理解を有している。それらの理解を、平和的紛争解決原則を基本とする現代国際法における紛争処理の法構造に照らしてみるならば、しかし、いずれも妥当な見解とは言えないことが明らかとなる。むしろ当該法構造の下では、対抗措置は交渉をはじめとする友好的紛争処理手続によっても紛争の解決を図ることが困難な場合における補助的手段として認められるものと解すのが適当である(補助的紛争処理手続論)。これは、各国家の通商制限措置にかかわる国内法の立法過程や、条約実行にも適合的である。また、国際法委員会による2001年国家責任条文草案も、このような観点から解するのが適当なものとなっている。補助的紛争処理手続論の観点からは、対抗措置の正当性根拠は紛争処理手続における補完的必要性に求められるが、それらは具体的には友好的紛争処理手続の促進の必要性、係争権利・法益の保全の必要性として現れる。これらの必要性は、対抗措置の発動時期や、執りうる措置の選択と程度といった、その規制条件(必要性原則及び均衡性原則)の解釈・適用を図る際の基礎となる。ただし、それら規制条件の解釈・適用のありかたについては、また別途、関連資料を収集した上で、研究を進める必要がある。
