本年度も、実態調査としては、決定手続との比較対象として、公開法廷での口頭弁論および弁論準備手続や進行協議の傍聴、調査を行った。ここではおもに医療訴訟を中心とする専門訴訟の充実・迅速処理、そのために導入された専門委員の運用状況を昨年度より継続して調査した。同時に、実務家参加の研究会に継続的に出席し、実務状況を知るとともに、これまでの調査研究に基づく試論を問い直す作業も行った。(1)実態調査公刊された決定のうち最近の事件をリスト化したほか、上記の通り昨年度から傍聴している事件の調査を継続した。近く事例検討としてまとめ、公表したい。(2)比較法本年度は、先行研究の蓄積が多いドイツ法とアメリカ法のほか、昨年度より調査を始めたイギリス法について検討を続けている。また昨年度より国際シンポジウムに出席するなどして各国の現状も学んでおり、イギリス法とフィンランド法にっいては、他の研究者との翻訳検討会をもちはじめたところである。(3)研究会実務家の参加する研究会に参加して、報告、討議を行った。今年度は、前回の研究分(平成14年度若手研究B14720043「民事訴訟における移送」)もあわせ、決定手続における裁判所の手続裁量につき研究報告を行い、実務家の意見を聴くことができた。近く成果をまとめたい。
