1.結社の自由の実効化という観点から、非営利団体法制の体系化を図るのが本研究課題の目的である。結社の自律的・自主的活動を支援する非営利法人制度のあり方を探求した昨年度に引き続いて、今年度は、非営利団体の活動・運営にとって最も重要な意味をもつ財政制度(優遇税制・補助金制度)に焦点をあてて、フランス法を素材とした比較研究を行った。2.本年度の研究で得られた知見は、以下のとおりである。第一は、フランスにおいて非営利団体は、商業課税(法人税・付加価値税・事業税)の納税義務を負わないこと、また、収益事業であっても一定の範囲内では免税措置を受けることである。これは、目下のわが国の税制論議において、2006年に新設された一般的な非営利法人である「一般社団法人」につき、原則課税の方向で議論が進められているのと対照的である。また、第二に、フランスでは非営利団体に対する寄附につき、所得税・法人税の優遇措置が認められていることである。これも、わが国では一定の公益的団体に対してのみ優遇措置が認められているのとは、対照的である。第三は、フランスにおいて非営利団体は、国および地方自治体から補助金を受給することが幅広く認められており、非営利団体と公共セクターとの間に密接な関係が認められていることである。この点は、わが国では民間団体への助成が公金支出として憲法で禁止されているのと正反対の態度を示すものといえ、憲法上重要な違いである。3.さらに、本年度は、現地で文献・資料収集を行ったほか、非営利団体に関する政府の調査・諮問機関である非営利団体活動中央評議会(CNVA)でインタビューを行い、その際、重要な統計資料・文書資料の提供を受けた。
