1990年代以降の国際開発援助の世界では、途上国の発展を阻害する根本的要因は、国家としての基本的な統治構造や法の支配、人権保障の欠如にあるという認識が徐々に高まり、特に世界銀行はいち早く「良き統治」の理念を援助政策の柱に据えた。本研究は、こうした開発援助の潮流の変化を国際法の枠組みに取り込む視点を提示することを目指して理論面・実証面から分析を進め、その結果、国家機能の正常化を目的とする能力開発支援が今日の開発援助において占める位置づけについて具体的なデータを収集することができた。また、国際法理論への示唆としては、そもそもこうした機能不全を抱える国家が成立しえた理由を通史的に解明する必要がある。つまり、発展途上国が実効的な国家機能を具備しないまま独立を達成することを可能にした法的論理を明らかにし、それが今日の「良き統治」型の開発援助にどのように結び付いていくのかを説明することで、現代の開発援助実践の起源や意義を国際法学において適切に位置づけることが可能になる。本研究では、こうした意味での開発問題の起源は、脱植民地化の過程における自決権概念に依拠した国家形成にあるという仮説を立てて研究を進めた。すなわち、大半の植民地は未だ国家基盤が確立していなかったにもかかわらず、そうした実効的国家性の不足を自決権概念が一時的に埋め合わせて独立を可能にしたのであり、その結果として、発展途上国は独立後に真の国家性を継続的に補完していくことが国際法上も要請されることになり、その一端が現代の「良き統治」支援なのではないか、ということである。本研究課題の研究期間では、この脱植民地化過程と現代の開発援助をリンクさせる論理を十分に構築するには至らなかったが、この点に関しては引き続き研究を進め、開発問題の意味を国際法学において位置づけ直すための基礎的な視座を提示することを目指したい。
