项目摘要

本研究は、中国の戦国時代の法制度と法思想、そして秦漢時代の律令について分析し、中国において律令制度が成立するにいたるまでの法制度と法思想のあり方を解明することを目的とするものであり、本年度はそのうち律令体制草創期の秦漢時代から律令制度完成期の唐代にいたるまでの律令体制の変遷を主たる対象として研究した。本年度の主たる研究実績としては、雑誌『簡帛』第三輯上に論文「東牌樓東漢簡牘五六號牘試探」が掲載されることが決定したことが挙げられる。東牌樓簡牘とは、後漢時代の地方官衙の遺構内にある古井戸から出土した簡牘であり、その内容は地方官衙の公文書・私文書である。そのうちの五六號牘は、これまで手紙・習字と考えられていたが、本論文によってこの木牘が實は魔除けのおふだであることを明らかにし、その木牘に描かれていた絵と、そこに書かれていた文字の意味を解明した。そしてこのような魔除けのおふだが官吏によって作成され、地方官衙の公文書の中に含まれていたことに注目し、後漢末の地方官衙が道教的な祭祀に深くかかわっていたことを論じた。本研究によって、東牌樓東漢簡牘五六號牘の意味が解明されたこと、またこの資料が後漢時代の地方官衙と道教成立を研究するうえで重要な価値を持つことが明らかにされた。
