本年度は、研究論文の作成、判例研究会における報告、外国語文献の書評を行った。研究論文については、前年度から継続して、アメリカとイギリスの「Business Improvement Districts(BIDs)」制度を手がかりに民間主体の地域管理制度の研究を行ってきた。具体的には、それらの国の裁判例や立法資料から法的問題点を整理するとともに、我が国における制度設計の可能性を検討してきた。今国会(第171回常会)には、地域の構成員による自主協定に法的効力を付与することを目的とした都市再生特別措置法等改正案が提出されており、BID制度とはやや異なる立法が目指されているものの、地域の公的サービスに必要な財源の確保と当該地域の管理の手法という点において、本研究はなお意義を有していると考えられる。今後は、以上の分析をまとめて、研究題目である「都市の財源確保に関する法制度の研究」の成果の一部とすることにしたい。判例研究については、日本財政法学会財政法判例研究会において、土地区画整理組合への職員派遣と給与支出の違法性が争われた裁判例を報告した。地方公共団体が行政施策を遂行していくうえで、公益的法人や民間の団体との連携は不可欠であるが、かつては、そのような団体への職員派遣については法制度が整備されていなかった。本件は、公益法人等派遣法施行後の事案であるが、判例評釈においては、同法の適用範囲を厳格に解すべきではないこと、同法の適用がなくても依然として地方公務員法の職務専念義務との関係で法的疑義が生じる場合がありうることを指摘した。書評については、フランスにおける公物理論に関する文献をとりあげた。本書は、フランスにおける公物の理論と制度の発展を、所有権の概念を軸に、歴史的かつ比較法的に論じており、国有財産の在り方などが問題となっている我が国から見ても示唆に富む内容であった。
