项目摘要

近年、クローン技術、万能細胞研究、ヒトゲノム・遺伝子解析研究など、先端医療技術の発展はめざましいが、それは同時に、倫理的・法的・社会的な問題を伴い、その規制を行う「生命倫理政策」の必要性が唱えられている。その結果、日本では生命倫理政策に関する多くの研究が進展しつつある。その一方で、生命倫理政策の歴史分析は必ずしも多く行われていない。「生命倫理委員会(政府審議会)」は小集団だが公共性が高く、法律や行政ガイドラインを通して、生命倫理や生命倫理政策に大きな影響を与えることが多い。まず、本研究は「生命倫理委員会」の役割に注目し、先行研究の成果に基づき「完全合意モデル」「重複合意モデル」「妥協モデル」「多数決原理モデル」という合意形成モデルを構築した。次に、日本と米国の代表的な生命倫理委員会を抽出し、合意形成モデルを分析枠組として用いて、生命倫理委員会の委員や事務局スタッフがいかにして「合意形成」を促したのか、という歴史的過程や問題点を分析した。米国の生命倫理委員会として、「国家委員会」「倫理諮問委員会」「大統領委員会」「生命医療倫理諮問委員会」「国家生命倫理諮問委員会」を選んだ。日本の代表的な生命倫理委員会(審議会)として、「科学と社会特別委員会」「生命と倫理に関する懇談会」「臨時脳死及び臓器移植調査会」「遺伝子治療に関する専門委員会」「科学技術会議生命倫理委員会」を選び、比較分析を行った。また、日米の共通の事例として、遺伝子治療に関する生命倫理委員会を選び、その審議の過程を詳細に分析した。さらに、日米の「比較史」研究の成果から、日本の生命倫理委員会における今後の課題を明示し、生命倫理政策に向けて「政策提言」を行った。本研究の意義は、生命倫理や生命倫理政策における生命倫理委員会の役割を明確にし、具体的な歴史的過程と合意形成モデルを分析したことにある。

Japan's representative Bioethics Committee (Review Committee), Special Committee on Science and Society, Symposium on Bioethics, Temporary Organ Transplantation Research Committee, Committee on Genetic Therapy, Bioethics Committee of Science and Technology Conference selected and conducted comparative analysis. A detailed analysis of the selection and review process of bioethics committees related to genetic therapy is presented. The results of the comparative history study in Japan, the future issues of the Bioethics Committee in Japan, and the policy recommendations for bioethics policy were presented. The significance of this study is to clarify the role of bioethics committees in bioethics and bioethics policy, and to analyze the process of forming consensus.
