憲法における環境関連規定の在り方につき、わが国において憲法改正の動きも前提として活発な法律上の議論が行われ、さらにそれらの議論が沈静化した現状を踏まえつつ、学問的議論を比較法的に深めた。特にドイツ、フランス、その他EU諸国並びにアメリカにおける環境権規定及びこれに関する議論を詳しく分析し、その結果、環境保護について憲法的価値を認めるとしても現実には多くの限界があり、環境意識、環境保護に資する特別な訴訟制度の充実等が必要であることが確認された。

In particular, the EU countries and other countries have made detailed analysis of the environmental regulations and related issues, and the results of the discussion have confirmed the importance of the constitutional framework for environmental protection, environmental awareness, and the adequacy of the special litigation system.
