This study aimed to analyze active arguments of Muslim scholars about authenticity of laws and institutions to control Non-Muslims. It was proved that theoretical establishment on government of Non-Muslims, which developed through argumentsamong Muslim law and historical books as well as narratives of the Prophet and his Companions from 9^<th> to 10^<th> century, was crucial for its institutional development. Moreover, these arguments reflected the political and social conditions of this period.

本研究旨在分析穆斯林学者关于控制非穆斯林的法律和制度的真实性的积极论点。通过对9 ~ 10世纪伊斯兰教法、历史典籍以及先知及其追随者的叙述的论证，证明了非穆斯林政府的理论建构对非穆斯林<th><th>政府的制度发展至关重要。此外，这些论点反映了这一时期的政治和社会状况。
