ドイツでは, 大学運営に競争原理・成果主義を導入することによって生じる法的な問題点について, 学説の蓄積がある。そこでは, 例えば, (1) 州立大学について国のコントロールがどの程度及ぶべきか, いかなる手法によるコントロールが適切か, (2) 大学入学資格の制度を通して学生に対して大学学修の機会を保障する配分参加権の理念をふまえて中央で学籍を配分する仕組みのもとで, 大学自身が独自の入試を実施することによって自由に学生を採用する制度をどのように構築すべきか, (3) 大学自身が授業料を決定することはどの程度可能なのか等について検討されている。上記(2) と関連して, ドイツでは大学入試や大学の修了と結びつけられている司法試験や医師国家試験の合否をめぐって行政訴訟が多く提起されており, 大学法の考察にとって国家試験制度の検討も憲法学・行政法学の重要な課題となっている。国家試験の合格者数を成果ととらえると, ドイツでは成果の公正さの確保に司法が果たしている役割が大きいと言える。一方, わが国では, 試験判定をめぐる紛争が, 必ずしも法律上の争訟とは言えないと考えられてきたため, 判例の数も少なく, 公正な試験判定のための解釈論・制度論を展開する素地が十分ではなかったと思われる。大学の成果の公正な把握のための解釈論・制度論を展開するためには, 試験争訟に関する豊富なドイツの判例を検討することが有益である。また, 大学間競争は, 学生の獲得競争でもある。そこでは, どのような入試戦略によってそれぞれの大学が学生を獲得するかが重要な課題となり, 入試制度のあり方が問われてくる。この点については, わが国では, 東京高裁平成19 年3 月29 日判決(判例時報1979号70頁)が, 入試判定において年齢を考慮することが可能か, という形で大学の入試判定における裁量の広狭を検討させる素材を提供している。大学間の競争を想定した新公共管理型大学運営のシステムにおいては, 大学入試制度における大学自身の判断の余地は拡大されるのかが問題となりうる。下記5(1) で揚げた判例研究では, ドイツの試験争訟の動向について簡単な紹介を行うとともに, わが国の試験争訟のあり方について若干の提言を行った(下記「4研究成果」を参照)。
