本研究は、消費者を一方当事者とする紛争の「調整的解決」(裁判、仲裁の裁定型に対して、調停等による紛争処理を指して広義に用いる。いわゆる裁判外紛争処理(民間型ADR)のみならず、我が国において伝統的な手法である裁判所付設民事調停(司法型)、建設工事紛争審査会等(行政型)を包含する。)をいかに促進するか、について日本とアジア・太平洋地域の運用実態の聞き取り調査と問題点の比較分析を、大型国際商事仲裁モデルと対比しながら行った。比較対象国において、各種の紛争解決方法に期待される役割や機能分担が異なること、それぞれの背景の下で「調停」促進が現代的課題となっている動向が裏付けられた。研究対象の2年間は日本では、「民間型ADR」や消費者行政(消費者庁設立)の制度整備途上の時期にあたり、新しい制度下での実態面の詳細調査(利用者側)は今後の調査を俟つ必要があるが、本研究からとくに手続主催者の養成(養成の仕組み、および資格(検定制度導入への賛否))、国際的な手続ルールの動向(とくに調停人等の選任)について、有益な示唆が得られた。

This study aims at the application of "adjudicated dispute resolution"(arbitration, etc.) in dispute resolution between consumers and one party. Civil mediation (judicial type), construction dispute review committee (administrative type), etc.(administrative type) are included.) A comparative analysis of the application status of the Pacific Ocean region and the large-scale international commercial arbitration. Compare the target countries, various dispute resolution methods, expectations, service division, function sharing, background, mediation, promotion, modern issues, trends, etc. The research object is a detailed investigation of the actual situation under the new system (user side) during the period of system preparation in Japan,"folk ADR" and consumer administration (consumer establishment), and the development of the main force in the future investigation.(Development of official organization, qualification (evaluation of system introduction)), international cooperation trends (selection of mediators, etc.)

山下理惠子律师受邀作为仲裁员参加一场涉及《联合国国际货物销售公约》（CISG）的国际商事纠纷模拟仲裁，并参加了文件审查和口头听证。
