项目摘要

応能負担原則に関するドイツの連邦憲法裁判所判決を中心とする新たな議論について検討した。そこでは、応能負担原則との関連で、納税者の財産権が保障された上に課税されなければならず、財産権との関係で課税の限界があることを示した。また、医療費控除を素材に主観的純額主義に関する日本法における具体的問題を検討し、わが国においては主観的担税力の減殺事由の考慮が不十分であることを示した。それを踏まえ、ドイツ主観的純額主義と応能負担原則の議論の妥当性について、調査・検討を進めている。

The principle of affordability is related to the decision of the federal constitutional court. The principle of affordability and the relationship between property protection and taxation of taxpayers are shown. This paper discusses the specific problems related to the purism of medical cost control and the reduction of tax burden of the main body in Japan. The pureness of the principle of affordability and the appropriateness of the discussion of the principle of affordability are discussed in detail.
