项目摘要

当初の予定では、地域貿易協定(RTA)における対抗措置を分析し、世界貿易機関(WTO)における対抗措置と比較検討する予定であったが、計画を若干修正し、3年目での実施を予定していたRTAとWTOの関係性の一般的分析を先に行うこととした。具体的な研究としては、EU司法裁判所とEFTA裁判所の間における「司法対話」の実績を踏まえて、RTAとWTOの紛争解決機関における類似の「対話」の可能性を探った。この分析を行う契機となったのは、最近のEUのRTA (EU・韓国FTA等)において欧州経済領域(EEA)協定で採用されている均質性原則と類似した規定が設けられるようになっていることであった。このような規定を明記したRTAはこれまでには存在しないため、WTOとRTAの紛争解決制度の相互関係について検討する上での新たな材料を提供するものと考えられる。EEAにおける均質性原則はEU司法裁判所とEFTA裁判所の間での解釈の統一性を確保することが目的であったが、副産物として、二つの裁判所の間の司法対話を促す結果をもたらした。すなわち、一方の裁判所が示した解釈が、他方の裁判所で採用され、ふたたび最初の裁判所で参照されるような、二つの裁判所でのやり取りを通じた判例法の形成である。EUは自らが締結したFTAにおいて、このEEAに見られる均質性原則に類似した規定を設けるようになっており、ゆえにRTAとWTOにおいても、そのような司法対話が生まれる可能性がある。これまでのRTAとWTOの紛争解決機関の相互関係に関する研究は、制度的な調整を主眼とするものであった。本研究は、EEAにおける実績を基礎に、「司法対話」という司法機関の主観的側面に着目してRTAとWTOの解釈の一貫性の実現を検討しており、その点に本研究の独自性があるものといえる。司法対話は、紛争解決機関間の相互理解に基づいた解釈の収敏を促すことから、国際通商関係における規律の安定性の実現に寄与する発想であると考える。

The analysis of the countermeasures against regional trade agreements (RTA) at the beginning, the comparison of countermeasures against international trade organizations (WTO) at the beginning, the revision of the plan, the implementation of the three-year plan, and the general analysis of the relationship between RTA and WTO at the beginning. The principle of homogeneity between the EEA and EFTA tribunals ensures the unity of justice between the two tribunals. The court of one party shall adopt the case law, the court of the other party shall refer to the case law, and the court of the other party shall adopt the case law. The EU has concluded FTA, EEA and the principle of homogeneity. Similar provisions have been set up. RTA and WTO have been established. The possibility of judicial dialogue has been established. A study on the relationship between RTA and WTO dispute settlement organs and the adjustment of the system This study focuses on the basis of the EEA's performance, the "judicial dialogue" and the bottom of the judiciary's main body, and discusses the consistency of the implementation of the RTA and WTO's resolution. Judicial dialogue can promote understanding among dispute resolution agencies and contribute to the realization of regularity and stability in international trade relations.
