项目摘要

今年度までで、憲法裁判所をもたずに違憲審査制を採用している、ブラジル、アルゼンチン、ウルグアイ、パラグアイという、南米南部地域諸国について、それぞれの国の違憲審査制の概要については、調査を一段落させることができた。この段階で、上記4カ国の制度について、共通項目を立てて、その横断的検討を行い、結果をまとめた論文を執筆し、現在、投稿を申請している。さらに進んで、アルゼンチンについては、連邦とかなり異質の、個性豊かな違憲審査制を採用する州も複数あるので、それら諸州の違憲審査制の有り方について俯瞰する作業を試み、論文を執筆し、雑誌に掲載した。また、これらの4カ国の、国レベルや州レベルの違憲審査制に影響を及ぼした周辺国の違憲審査制について調査を開始し、その第一歩として、かなり個性的といえるコロンビアの違憲審査制について現地調査を行ったので、その成果を今年度中の雑誌論文として発表することを予定している。
