项目摘要

研究期間の最終年度にあたる今年度は,主として以下の二つの作業に取り組むとともに,それらを統合して研究課題を完成させた。第一に,1985年に行われたコンピュータ・プログラム著作権創設に至る政治過程の事例分析である。第二に,1970年に行われた著作権法全面改正の事例分析である。第一の作業においては,「法の整合性」による法改正への影響に注目した分析を行った。扱った事例は新規政策分野の管轄をめぐる官庁間の対立が存在するものであった。従来の理解では,このような類型の事例は,より多くの権限や資源を獲得することで自らの「活動量」を増加させようとする官庁同士の争いであると捉えられてきた。しかし,分析の結果,官庁が「法の整合性」と政治家からの「自律性」を重視した結果として新規政策分野の管轄を志向するという争いの類型が存在しうることが明らかになった。この研究成果については,査読付きの学会誌において論文として公表した。第二の作業においては,前年度の作業から明らかになった利益団体のもつ政策帰結に対する影響力が,どのような要因によって規定されるのかを明らかにすることを試みた。ゲーム理論モデルから導かれた仮説を,事例分析で検証するという手法を採用することによって,以下のことが明らかになった。すなわち,利益団体が自己の政策選好に近い政策帰結を実現できるかどうかは,政権党を動かして自己に不利益な政策を修正できることを官庁に認識させているかどうかということに左右される。この研究成果についても,査読付きの学会誌において論文として公表した。以上の作業を統合した研究成果は,博士論文としてまとめた。また,北海道大学大学院法学研究科からの招きを受けた研究会において,口頭にて報告を行った。
