项目摘要

研究期間の初年度にあたる今年度は,主として二つの作業を行った。第一に,応用美術に関する規定の事例分析である。第二に,私的録音録画補償金制度に関する多国間比較分析に向けた準備作業である。以下,二つの作業についてより詳しく述べる。第一の作業においては,政治過程における重要なアクターであるにもかかわらず政策形成過程の参加者としてこれまであまり分析されてこなかった,日本の裁判所に注目した分析を行った。著作権法における応用美術の保護のあり方には大きな問題があることが1970年の著作権法全面改正時から指摘されているが,その後40年間法改正は行われず放置されている。応用美術の保護の程度という政策帰結を制定法だけに注目して捉えると,政策の決定についての重要な権限をもつ文化庁の政策選好とは一致していない。また,決定的な権限をもつ他のアクターが文化庁の政策選好に沿うような法改正に対して強く反対しているわけではない。それゆえ,裁判所による政策帰結への影響にあまり目を向けない従来の政策過程研究の観点からみれば法改正が行われる余地は十分に存在しているのにもかかわらず,実際はそうはなっていないといえる。これに対して報告者は,裁判所の出す判決が蓄積して政策帰結が変化したことに注目し,法改正を行う文化庁等のアクターのインセンティブが変化したために法改正が行われなかったという説明を提示した。この研究成果については,学会において報告用論文および口頭によって報告を行った。第二の作業においては,私的録音録画補償金制度の多国間比較分析の準備段階として,分析対象である4ヵ国(日本,アメリカ,ドイツ,イギリス)の著作権法における私的録音録画をめぐる現状の制度とそこに至る変遷の過程を把握することを試みた。次年度以降の課題は,この制度的差異と変遷に対する有力な説明変数となりうる政治的要因を明らかにすることである。
